  "1.There will be a $50.00 service charge for any checks returned by the bank to Premier Properties USVI 2. No pets or animals will be allowed on the premises unless the owner grants prior permission. 3. In the event of any breach by the guest as to any of the terms or conditions, hereof, the owner through his agent shall have the right to cancel this agreement. 4. I have read and agree with the Rental Terms & Conditions and they are hereby incorporated as part of this agreement. 5. THIS IS A NON-SMOKING PROPERTY, PLEASE OBSERVE THIS REQUEST. 6.No more than the approved number of guests for the reservation. Rental Terms & Conditions Premier Properties USVI This Vacation Rental Confirmation becomes a binding agreement when you send us your rental deposit.  Receipt of payment to this invoice constitutes your acceptance and agreement to these terms, conditions, limitations and restrictions as printed below. If you have any problems or questions with any of the following, please be sure to phone us BEFORE you send us your rental deposit monies. Thank you. PAYMENT AND CANCELLATION POLICIES: Failure to make this payment subjects your reservation to automatic cancellation.  All cancellations and any request for changes to your reservation (such as date changes or changes in the number of persons) must be made IN WRITING. Once  Premier Properties USVI has received your deposit, if you cancel/change your reservation 120 days or more prior to arrival, there is a 10% penalty of the total room charge. If you cancel/change your reservation 60-120 days prior to arrival, there is a 50% penalty off the total room charge. If you cancel/change within 60 days of arrival, there is a 100% penalty off the total room charge. If your cancelled dates are rebooked to another guest at the same rate, any greater penalty charge will be reduced to 10%. Christmas/New Years and President weeks are non-refundable unless your cancelled dates are rebooked. If you need to change or cancel any portion of the services you have booked, please notify us IN WRITING (by fax or letter). No shows, late arrivals, change in number of persons, and early departures after arrival are non-refundable. Guests who abandon their villa without authority from Frazier Premier Properties agree they have no rights to compensation. TRAVEL INSURANCE AND TRIP CANCELLATION INSURANCE We strongly suggest you purchase travel insurance to cover your costs in the event you are forced to cancel your trip. There are many providers of this coverage. One that our Guests have used is IMG Global. Their web site is: www.IMGlobal.com . Under the “Products and Services” tab, select “Travel Insurance / Trip Cancellation” to see your choices of coverage. ESCROW ACCOUNT: Guest understands that all rental monies shall be deposited in a non-interest bearing escrow account. ACCIDENTAL DAMAGE WAIVER: Every guest reservation is required to include an Accidental Damage waiver of $49. This waiver will cover accidental damages to the unit during a stay up to $500. If the damage to the property exceeds $200, the guest is responsible for the balance and the pre-authorized credit card we have on file will be charged. All damages must be reported to manager by each guest immediately in order for the waiver to cover the damage. This Damage Waiver does NOT cover intentional damage, theft, or excessive cleaning, or any damage or flea infestation caused by a pet. Please do not hesitate to report an accident as this waiver is in place to protect the property but also encourage guests to work with the managers. YOUR VILLA: Locked pantries and closets are reserved for the use of the villa owner and are not included in this rental. You as the Guest agree to take all reasonable steps to ensure that your family and other guests in your party adhere to the rules and regulations affecting your villa. All villas are privately owned, so décor, colors and inventories will of course vary. All villas are fully furnished, including an ample supply of bed linens and towels for Guest's use. Rearranging the furniture or removing any items from the villa is prohibited. LIABILITY: Premier Properties USVI is acting hereunder as agent for accommodations, and assumes no liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may be occasioned either by reason of defect in any vehicle or the acts of any company or persons engaged in conveying passengers to or from their villa. Transportation (airlines, rental cars and taxis) are supplied by providers who operate independently of Premier Properties USVI. We assume no responsibility, therefore, for any loss, injury, or damage to person or property because of the acts of those providers. Furthermore, Guests are responsible for their villa during occupancy, and must lock villa's windows and doors securely when not on the premises. NO PETS: Pets of any kind are not allowed in or on the villa's premises without specific written permission from Premier Properties USVI (granted prior to arrival). A pet or evidence of a pet found on premises will cause immediate eviction, and forfeiture of Guest's entire rent and deposit. SMOKING: This is a non-smoking unit, please observe this request. COMPLAINTS AND MAINTENANCE: Premier Properties USVI shall make every effort to keep all villas and their inventories in good working order. In case of a maintenance problem, we will strive to repair the problem as soon as possible after being notified. However, no refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, water, pool filtration systems, air conditioning, television or cable service, appliances, etc. It is Guest's obligation to report any problems or damage IMMEDIATELY to us, regardless of the hour. ENTRY INTO VILLA: Premier Properties USVI or its staff may enter your villa to perform any repairs as necessary. If your villa is on the market for sale, we reserve the right to allow the villa to be shown, but only by advance appointment made with Guests. We will make every effort to schedule such brief showings at a time convenient to you, to respect your privacy, and not interrupt your vacation. SUBSTITUTION: Premier Properties USVI reserves the right to substitute comparable or better accommodations without liability should the reserved villa be out of order, sold or deemed substandard by us for any reason.  If comparable accommodations satisfactory to Guest are not available, Guest may receive a complete refund of all pro rated rent and hotel tax paid for the original villa. DRUGS AND HAZARDOUS MATERIALS: Guest and members of the party shall not use or permit to be brought into any villa any illegal substances, inflammable fluids (e.g., gasoline, kerosene, naphtha or benzene), or other explosives or articles deemed hazardous to life, limb or property. VILLA KEYS: Premier Properties USVI shall charge Guest $25.00 for each set of lost or mishandled keys. CAPACITY OF VILLAS: The total number of persons allowed in the villa at any one time is restricted to the number of persons scheduled and paid for. Should a group misrepresent themselves, they will be required to pay for the excess persons immediately, or shall vacate the villa without refund. Exceptions are made only for infants; they are NOT included in the villa's total headcount. HURRICANE POLICY: In the event of a pending hurricane, all guests MUST vacate the Villa when instructed to do so by Premier Properties USVI staff. (Any unused rent and taxes will be refunded). It is the sole responsibility of the guest to secure other lodging or change airline tickets for an early departure. QUIET ENJOYMENT AND PARTIES: Premier Properties USVI wishes to maintain a family atmosphere for the quiet enjoyment of Guests. We rent to family groups and responsible adults only; absolutely NO house parties or functions such as weddings are allowed without advance WRITTEN permission from Premier Properties USVI. Guests shall be sufficiently quiet and peaceful, so as not to disturb other residents of the neighborhood. In any dispute arising out of this rent agreement, the laws of the Virgin Islands shall apply and the prevailing party shall recover its costs, expenses and reasonable attorneys' fees."
